One of the men accused in the 2008 shooting death of Rey Valdez walked free Monday after pleading guilty to one charge of engaging in organized criminal activity for assault.
George Buford Scott, 38, pleaded guilty to the charge after having the other three charges dismissed, including murder, engaging in organized criminal activity for murder and an identical charge to his plea.
As was specified in the plea deal he made in exchange for testifying in May against Billy Wayne Haynes, the former leader of the Aryan Circle, he was sentenced to two years in state jail. But Scott also got credit for 935 days of time already served in jail.
“So you’re giving time served?” Judge John Smith said to prosecutor Amanda Navarette, before turning to Scott. “Looks like the state owes you time back.”
Defense attorney John Cliff said that wouldn’t be necessary.
Scott was one of five former Aryan Circle members to testify against Haynes. David Callaway and Greta Caldwell were no-billed in the case, and Kevin Jackson and Summer Wilkins had their charges dismissed by the District Attorney’s Office.
Haynes was convicted in a jury trial and sentenced to life in prison on the murder charge and 50 years in prison on an engaging in organized criminal activity charge [http://www.oaoa.com/articles/haynes-65314-guilty-trial.html]. The sentences run concurrently.
